DOCUMENTED FACT (as recited in later records). WGR obtained summary judgment under Order 14 against Frederick Buckler alone, expressed to cover “the whole of the farm”. Mary, who lived in the house and claimed to own it, was not a party. See The 1955 Possession Order.
- The operative wording, and whether it defines “the farm” by plan, acreage or parcel. The family’s account is that it did not.
- Whether the affidavit disclosed that Mary lived in the house and disputed ownership, or mentioned the 1939 plan (DBDT123/7) or the 1938 conveyance (E121).
- Whether the order, as written, covers the farmhouse and garden, and whether Mary was served, accepted it or resisted it.
- Whether any plan was attached.
