1987 Judgment Reconstruction Matrix
Reconstruct the litigation from the court record rather than from later summaries.
| Step | Required record | Question |
|---|---|---|
| 1. Pleadings | Claim, defence, counterclaim and amendments | What exactly was each party asking the court to decide? |
| 2. Evidence | Witness statements, exhibits, plans, deeds, correspondence | What evidence was actually before the court? |
| 3. Submissions | Skeletons, written/oral submissions where retained | What propositions were advanced and answered? |
| 4. Findings | High Court judgment and reasons | Which propositions were actually decided? |
| 5. Appeal | Court of Appeal judgment and papers | What was affirmed, rejected, omitted or left undecided? |
| 6. Later material | Records discovered after judgment | Was the material unavailable then, undisclosed, misunderstood or merely overlooked? |
| 7. Materiality | Document-to-proposition analysis | Could the new or suppressed material realistically change a material finding? |
| 8. Remedy | Procedural/legal route | What route, if any, remains legally open? |
Fraud control: do not label the judgment fraudulent because the Wiki has found contrary evidence. First establish what the court was told, what was available, what was withheld if anything, and the legal consequence.
