Record class: Dedicated evidence placeholder / lead, created 15 October 2026. This page tracks a reported 1954 event; it is not itself a contemporaneous 1954 document.

Evidence status

Family chronology: 1954 is identified as a further attempt to place Frederick Buckler in the position of a tenant. The family treats this as an additional, unsuccessful attempt to characterise occupation of Parcel A as permissive, distinct from the separate unwritten agricultural tenancy beginning in 1949. The original 1954 source has not yet been attached to this page; the exact terms, author, recipient, proposed land and reason the attempt failed must be checked against the original record.

Important distinction and source-control note — checked 15 October 2026: the accessible published text of BP Properties Ltd v Buckler [1987] EWCA Civ 2 does not mention the year 1954. It records a letter from WGR’s agents dated 10 October 1952 saying they did not propose to proceed with the letting, but Dillon LJ nevertheless concluded that, despite the absence of a written agreement, Frederick had a protected periodic agricultural tenancy ending by notice on 2 February 1955. The 1949–1953 tenancy must not be erased or described as fictional. Accordingly, this page preserves the separately reported 1954 attempt as a family-chronology event pending its original source; it must not be attributed to a specific statement by Dillon LJ unless a separate trial judgment, transcript or record establishes that attribution. Nor does the present record establish that the recognized agricultural tenancy lawfully covered Parcel A.

Description

This placeholder records the family’s identification of an additional tenant-making / permissive-characterisation attempt in 1954, between the 1949–1953 agricultural tenancy and the 1955 possession proceedings. It preserves the event as a distinct chronological issue while avoiding an unsupported statement about the precise instrument or parcel until the underlying source is identified.

Interpretation and significance

If confirmed by the original source, the 1954 event belongs in the sequence of attempts to treat Frederick’s or Mary’s occupation as tenancy-based rather than as occupation under the family’s asserted Parcel-A title. Its significance depends on exactly what was proposed: a tenancy of Parcel B, Parcel A, the occupied farmhouse and garden, or a broader “whole farm” holding. The wording and land description matter.

This is a line of enquiry, not proof of a deliberate plan to mislead. Nor does the event alone establish that the court was wrong. The forensic questions are: what exactly was attempted in 1954; was its scope Parcel A, Parcel B or both; why did it fail; and was it placed before Hollis J or the Court of Appeal? The published appeal report’s express tenancy finding concerns the 1949–1953 periodic tenancy despite the 1952 letter; that finding and the parcel-scope issue must be assessed separately.

Required source and checks

  • Locate and attach the original 1954 letter, proposed tenancy, solicitor/agent correspondence or other record identifying the attempt.
  • Record who proposed it, who was to become tenant, Mary’s and Frederick’s responses, why it failed, and whether the attempt concerned Parcel A, Parcel B or both.
  • Compare it with the 1949–1953 tenancy record, the 1952 agents’ letter, the 1955 High Court claim/order and the evidence actually before Hollis J and the Court of Appeal.
